These Website Terms of Use (“Terms”) govern your access to and use of the website located at brandstardigital.com and any related subdomains (collectively, the “Site”), which is owned and operated by BrandStar Digital, LLC, a Florida limited liability company (“BrandStar Digital,” “Company,” “we,” “us,” or “our”).

BY ACCESSING OR USING THE SITE, YOU AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE, PLEASE DO NOT ACCESS OR USE THE SITE.

These Terms apply to visitors browsing the Site. They do not govern the scope of services, pricing, or contractual obligations between BrandStar Digital and its marketing clients — those relationships are governed exclusively by a separately executed Master Services Agreement or Statement of Work.

The Site is intended for users who are at least 18 years of age. By using the Site, you represent that you meet this requirement and that you have the legal capacity to enter into these Terms.

2. Use of the Site

You may use the Site for lawful purposes only. You agree not to:

8. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, BRANDSTAR DIGITAL AND ITS OFFICERS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE SITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. BRANDSTAR DIGITAL’S TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING FROM YOUR USE OF THE SITE SHALL NOT EXCEED ONE HUNDRED DOLLARS ($100).

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or your use of the Site shall be brought exclusively in the state or federal courts located in Broward County, Florida, and you consent to the personal jurisdiction of such courts.

12. Severability; Entire Agreement

If any provision of these Terms is found to be unenforceable, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect. These Terms, together with our Privacy Policy, constitute the entire agreement between you and BrandStar Digital regarding your use of the Site.
